Terms of Use and Booking Terms

These terms apply to your use of stay-caribbean.com (the "Site") and to enquiries and referrals made through it. Please read them carefully. By using the Site you agree to these terms. If you do not agree, please do not use the Site.
1. About us
The Site is operated by Stay Caribbean Limited, trading as StayCaribbean ("we", "us", "our"), a company registered in England and Wales (company number 11409903) with its registered office at 141 Chestnut Rise, Plumstead, London, SE18 1RN, United Kingdom.

2. Our role: an enquiry and referral service
StayCaribbean helps you find places to stay, tours, boat charters, airport transfers and car hire across the Caribbean and Central and South America. We are an intermediary. We do not own, operate or manage any of the properties or services listed, and we are not a tour operator or travel agent selling package holidays.
Listings on the Site are one of two types:
- Partner listings: listings provided by local owners and operators ("partners"). You send an enquiry through the Site, we pass it to the partner, and the partner replies to you to confirm availability, price and terms.
- Referral listings: listings where the "Check prices & book" button takes you to a third-party website, such as a hotel, an operator, Airbnb or an affiliate booking site. We may receive a commission from that third party if you book, at no extra cost to you.
We do not take payments on the Site. Online booking through StayCaribbean is not available yet. If we introduce it, we will update these terms before it goes live.
3. Your booking is with the provider
Any booking you make, whether directly with a partner after an enquiry or on a third-party website, is a contract between you and that provider (the property owner, hotel, operator or booking site). StayCaribbean is not a party to that contract. The provider is responsible for:
- confirming availability and the final price, including taxes, fees and deposits;
- its own booking, payment, cancellation, change and refund terms;
- delivering the accommodation or service as described, and its safety, licensing and insurance.
Please read the provider's terms before you book or pay. Any questions or complaints about a booking should go to the provider first. We are happy to help you get in touch with a partner where we can, but we cannot guarantee the outcome.
Please make sure you have suitable travel insurance and the passports, visas and health documents you need for your destination.
4. Prices, availability and listing information
Prices shown on the Site are a guide only. They may be "from" prices, may not include taxes or fees, may be out of date, and may change at any time. Availability is not guaranteed until the provider confirms it. The price and terms that apply are the ones the provider confirms to you.
Listing descriptions are based on information supplied by partners or by third-party sources. We take reasonable care in reviewing listings before they go live, but we do not inspect every property or service and cannot guarantee that every detail is complete, accurate or current. 5. Images
Many photos on the Site are illustrative. They may show the destination, area or type of accommodation or activity rather than the specific property, room, boat or vehicle you would book. Many images come from Wikimedia Commons and are credited on our Photo Credits page. Please ask the provider for photos of the actual property or service before you book.
6. Partner listings
Partners are responsible for the accuracy of the information, prices and photos they provide, for holding any licences, permissions and insurance they need, and for honouring the bookings they confirm. Partners use the Site under our separate partner terms, which are provided on sign-up. We may refuse, edit or remove any listing at our discretion.
7. Third-party websites
The Site links to websites we do not control. We are not responsible for their content, availability, prices, terms or privacy practices. Your use of a third-party website is at your own risk and under that website's terms.
8. Accounts
If you create an account, keep your login details confidential and tell us straight away if you think someone else has used your account. You must be at least 18 to create an account or send an enquiry. We may suspend or close accounts that break these terms.
9. Acceptable use
When using the Site you must not:
- break any law or use the Site for any fraudulent or harmful purpose;
- send false enquiries, spam or unsolicited marketing, or misuse the contact details of partners;
- submit content that is false, misleading, offensive, defamatory or that infringes anyone else's rights;
- try to gain unauthorised access to the Site, its servers or any account, or introduce viruses or other harmful code;
- scrape, copy or harvest content or data from the Site by automated means without our written permission;
- interfere with the proper working of the Site.
10. Intellectual property
The Site's design, text, logo and the StayCaribbean name are owned by or licensed to us. Third-party images remain the property of their owners and are used under their licences, as shown on our Photo Credits page. You may view and print pages for your own personal, non-commercial use. You must not otherwise copy, reproduce or reuse Site content without our permission or, for third-party content, the owner's permission.
If you submit content (such as listing details, photos or reviews), you confirm you have the right to do so and you give us a non-exclusive, royalty-free licence to use, display and adapt it on the Site and in promoting StayCaribbean.
11. Availability of the Site
The Site is provided free of charge. We try to keep it running smoothly, but we do not guarantee it will always be available or free of errors, and we may change, suspend or withdraw any part of it.
12. Our liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law. Nothing in these terms affects your statutory rights as a consumer.
Subject to that:
- we are not responsible for the acts, omissions, accommodation or services of partners or third-party providers, or for any contract between you and them, because we are not a party to it;
- we are not responsible for loss caused by inaccurate information supplied by partners or third parties, or by changes in price or availability, where we have taken reasonable care;
- we are only responsible for loss that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable;
- if you use the Site for business purposes, we are not liable for loss of profit, business, revenue or opportunity.
13. Changes to these terms
We may update these terms from time to time. The version on this page when you use the Site applies. Please check it regularly.
14. Complaints
If you have a complaint about the Site or our service, email hello@stay-caribbean.com and we will aim to reply within 14 days. Complaints about a booking should be raised with the provider first.
15. Law and courts
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts. If you are a consumer living elsewhere, you keep any protection given to you by the mandatory laws of your country of residence.
